This Agreement sets forth the terms and conditions governing your use of the clinical notes generation platform provided by Leafy Notes LLC (“Company,” “we,” or “us”). By signing up or generating clinical notes on our platform, you agree to be bound by this Agreement. If you do not agree to these terms, please refrain from using our platform.
1. Use of the Platform
a. The clinical notes generation platform offered by Leafy Notes LLC is intended for informational purposes only and does not replace the expertise and judgment of healthcare professionals. The generated clinical notes are intended for reference purposes and should not be considered as professional medical or therapeutic advice.
b. You are responsible for the accuracy and appropriateness of any information or content generated through the platform. The use of the generated clinical notes is at your own risk.
c. You agree not to use the platform for any unlawful purposes or in violation of applicable laws or regulations.
2. Protection of Personal Health Information (PHI)
a. Leafy Notes LLC does not store or save any personal information or generated clinical notes on the platform. Once the clinical notes are generated, they are displayed to the user, and no copies are retained or stored by Leafy Notes LLC.
b. You agree not to enter or transmit any personal health information (PHI) through the platform. Any sharing or transmission of PHI through the platform is strictly prohibited.
c. While Leafy Notes LLC takes reasonable measures to protect the security of information transmitted through the platform, please note that no method of transmission over the internet or electronic storage is completely secure. Leafy Notes LLC cannot guarantee the security or privacy of any information transmitted through the platform.
3. Compliance with Applicable Laws
a. You are responsible for complying with all applicable laws and regulations when using the platform, including but not limited to privacy laws, data protection laws, and regulations related to the protection of personal health information (PHI).
4. Intellectual Property
a. All content, including but not limited to text, graphics, logos, software, and generated clinical notes, on the platform is the intellectual property of Leafy Notes LLC and is protected by copyright, trademark, and other intellectual property laws.
b. You may not copy, modify, reproduce, distribute, display, or use any content from the platform for commercial purposes without obtaining explicit written permission from Leafy Notes LLC.
5. Limitation of Liability
a. In no event shall Leafy Notes LLC, its affiliates, employees, agents, or partners be liable for any direct, indirect, incidental, consequential, or punitive damages, or any damages whatsoever, arising from the use of the platform, including any inaccuracies or errors in the generated clinical notes. This limitation of liability applies to the fullest extent permitted by law.
6. Termination
a. Leafy Notes LLC reserves the right to terminate or suspend your access to the platform at any time and without prior notice.
7. Governing Law and Jurisdiction
a. This Agreement shall be governed by and interpreted in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions.
b. Any dispute arising out of or relating to this Agreement or the use of the platform shall be exclusively resolved in the state or federal courts located in Maryland.
By signing up or generating clinical notes on our platform, you acknowledge that you have read, understood, and agreed to be bound by this User Agreement.
